The present User’s Agreement (hereinafter referred to as "UA") regulates the trucks between the Fun Factory LLC (hereinafter referred to as "Company") and individual person, which is specified below and expresses his agreement with the terms of the present "UA" by the registration in the "NIKITA.ONLINE Passport" service (hereinafter referred to as "NIKITA.ONLINE Passport"), which are based on the accordance of access and using the Internet-Projects with the united registration service "NIKITA.ONLINE Passport".

1. Terms and Definitions.

For the aims of the present "UA" the following terms and definitions are used:
"Internet-Project" is a service of the game, entertainment or informational character, trade grounds, provided by the trademark "NIKITA", connected to the "NIKITA.ONLINE Passport", which can be accessed with the internet connection.
"User" is an any registered on the "NIKITA.ONLINE Passport" with the aim of access and using the "Internet-Project" accordance individual. (In some cases, which are fixed in the 3 issue of the present "UA", it is an individual person of the full legal age).
"Internet-Project Administration" is the officeholder, who realizes the administrative control and technical support of the "Internet-Projects" and act under the name and order of the "Company".

2. The object of the User Agreement

The Company provides the rights of access and using the Internet-Project for the User by the means of the registration in the "NIKITA.ONLINE Passport" on the terms, which are fixed in the present UA. All changes and/or additions to the present UA as well as the new redaction of the UA are realized by the Company in the unilateral way. All changes and/or additions to the present UA as well as the new redaction of the UA take an effect during the 3 days from the publication on the web page http://my.gamexp.ru/help/rules.php, if the other is not defined in the new redaction of the UA. The UA as amended is always situated on the page. The User always has a right to reject additions or changes in the present UA, made by the Company and it means the refusal of the User of the Company services and the breaking off the present UA.

3. The Services Definitions

The Company offers the services of the access to the wide range of different "Internet-Projects", provided by the trade mark "NIKITA", for the Users. All existing Internet-Projects on the moment of the registration by the User in the "NIKITA.ONLINE Passport" and also all developments and/or additions are the objects of the present UA. The User accepts and agrees with the fact, that all Internet-Projects are provided "as is" and that the Company is not responsible for any delays, fails, incorrect or untimely delivery, deleting or non – safety of any private user information. All problems of the purchasing the Internet connection by the User and buying and setting all the hardware and software are solved by the User independently and they are not the object of the present UA. The Company draws Users’ attention to the fact that some Internet-Projects contain the information only for individual persons which are of full legal age. This fact is mentioned on the main page of such Internet-Projects. The present UA orders the individuals younger than 18 years not to access such information and such Internet-Projects.

4. User liabilities of the registration, the password and the security.

In the order to access the Internet-Projects, User should go though the registration process which is provided by the "NIKITA.ONLINE Passport". User is obliged to provide exact and right information about himself in compliance with the Registration form and keep on this information actual. In the cases of incorrect user information or suspicions of the Company that the information is incorrect the Company has a right to delete the User account or to deny the access to all or to the part of Internet-Projects. User receives login and password to the private part of "NIKITA.ONLINE Passport" and Internet-Projects after completing the registration process. The User responsible for the safety of login and password and also all actions, made under his login and password in "NIKITA.ONLINE Passport" and Internet-Projects. Company has a right to deny the use of defined logins or to withdraw them. User agrees with the facts, that he must immediately inform "NIKITA.ONLINE Passport" about any cases of unapproved access under his users’ account or about any cases of breaking of security, also about the fact that User ends the work with the private part of Internet-Projects by himself ("Exit" button). Company is not responsible for loosing or damaging the data, which can be because of the breaking the rules of this part of the UA by the User. The issues of the present UA are necessary for all registering and registered earlier Users.

5. Conduct of the Registered User.

The User accepts and agrees with the fact that he responsible by himself for all possible consequences that can be a result of placing the information (data, texts, diagrams, photos, messages and other information) for the public, or a result of handing over the private information, including the registration information or a result of any other actions using the "NIKITA.ONLINE Passport" and Internet-Projects. Company does not control the information, which is received through the Internet-Projects and so, couldn`t guarantee it`s quality, exactness and fullness. User understands and agrees the fact that while using Internet-Projects he can come across the information of the other Users, which can be offensive, mean or incorrect. Company under no circumstances does not responsible for the information, placed by Users of Internet-Projects. User understands and agrees with the fact that the Company has a right to block shady accounts. Such accounts can be unblocked only after rechecking and providing arguments of guiltlessness by the User. User understands and agrees with the fact that he has no right to act in order to receive unapproved access to the privileged information and to "NIKITA.ONLINE Passport" and Internet-Project resources (computers, hardware and software), to use such access or to delete and modify data, which doesn`t belong to the User.

User is obliged not to use Internet-Projects for:

a) Storing, placing and delivery of data and information which are illegal, harmful, threatening, slanderous, abusive the morality, breaking the author rights, propagandizes the discrimination of humans by the ethnicity, sex, religious, social signs, containing offenses to individuals or organizations;
b) Breaking the rights of under age individuals and/or harming them any way;
c) Infringement of the rights of the minorities;
d) Introducing as another person, without any rights to act like this, including Company and/or Internet-Projects officials and also to mislead Users about properties of any subjects and objects;
e) Publication, placing and/or delivery of data and information, which are not allowed to be available by the laws of the Russian Federation and/or in accordance to contract relations;
f) Publication, delivery and/or other ways of placing data and information, which break the patent, trademark, commercial classified information, copyright and other ownership rights, author and allied rights of third persons and sides;
g) Publication and delivery of advertising, excepting the situations, when it is allowed by the Company in written form, private information about third persons, "pyramid" schemes, Multi-Level-Marketing (MLM), internet and e-mail business, "letters of happiness";
h) Spamming – delivery for more than 10 addressees , which is unapproved and/or unexpected by recipients, containing advertisements, and also repeating unapproved mail for one addressee;
i) Publication, placing and/or delivery of data and information, that contains viruses and/or another computer codes, files and programs, assigned to damage, destruct and/or confine functional possibilities of computer and telecommunication hardware or software, to realizing an unapproved access and also delivery of serial numbers and programs, that help their generation for commercial programs, logins, passwords and another way of getting the unapproved access to paid Internet-Projects, and also placing links on the foregoing information;
j) Wilful defiance of the laws of the Russian Federation or international laws;
k) Delivery of messages, that contain rude and mean phrases or proposals, including the delivery for technical support of Internet-Projects;
l) Gathering and keeping the private information about other persons;
m) Wilful disturbance of normal working process of any of Internet-Projects, including the "NIKITA.ONLINE Passport";
n) Placing the links on the Internet resources, which contain illegal information.

The messages from "NIKITA.ONLINE Passport" and Internet-Projects administration, that contain technical information about "NIKITA.ONLINE Passport" and Internet-Projects are not spam.

User agrees with the fact, that his account can be deleted without any notifications in the cases when:

• in Internet-Projects are used insulting, mean, threatening, humble phrases and expressions against other Users and also information, aimed on defiling the User or a group of Users by the sex, age, ethnicity, religious, language, professional, place of residence, workplace, political signs;
• Internet-Projects are used for public wrong actions, including: disclosure of information, which is government or another guarded secret, information about ways, methods of developing, making or using, places of obtaining of drugs and their components; advertisements of any advancements of drugs and their components, psychotropic substances, for extremist actions, for spreading advertising information about porno, violence and cruelty cult and another information interdicted by laws of the RF;
• User is trading, excepting the cases when it is allowed in Internet-Project;
• Attempts of realizing the following actions are made by the User: exchanging accounts, game items, game objects, game resources, game services of Internet-Projects to legal paying means( money, securities, e.t.c) if it is not allowed by the Company. To speak another words, prohibited to selling anything in Internet-Projects without Company permission;
• User is using mistakes in program codes of Internet-Projects (hereinafter referred to as "Bug") for getting unexpected advantages in Internet-Projects. If the User has information about bugs, he should report about it to the technical support via e-mail, mentioned on a corresponding website of each Internet-Projects;
• User makes any actions, that can raise difficulties for Administration with supporting good work of Internet-Projects;
• User is sending to the Company servers nonsensical and/or useless information, which create an additional load for the servers and which is more than minimal checking rate;
• User is using programs for automatically repeating actions of User character, when User do not control it by himself ( hereinafter referred to as "Macros") are used;
• User is introducing himself via any accessible in Internet-Projects way to other Users as an administrator, technical support member or a Game master;
• User is not fulfilling demands of administration and Game Masters;;
• Text or binary files of Internet-Projects are modified by User ( both client and server part)
• User is broke the following rules about character names in Internet-Projects:
  1. Usage of the name of game creatures and non-player characters of game, and also names, that are mentioned in the official history of the Game:
  2. Usage of registered trademarks as names of characters:
  3. Usage of the following words in the names of the characters: тест, test, админ, admin, support;
  4. Usage of the names, that begin with the prefix "GM"
  5. Usage of the names, that contain unquotable phrases and expressions.

The list of inadmissible name is not full. It can be amplified with another rules by the Company without any agreements with the User.

6. The terms of usage of the "NIKITA.ONLINE Passoprt"

On registering in "NIKITA.ONLINE Passport" User agrees no to copy, publish, sell, exchange or to use for commercial purposes any parts of "NIKITA.ONLINE Passport" or Internet-Projects. On registering in the "NIKITA.ONLINE Passport" User gets a right to use his account and Internet-Projects only by himself. User has no right to hand over his account to third persons or to take their account without a Company permission. Company is not responsible for any contracts between User and third persons. User understands and agrees with the fact, that Company has a right to limit User abilities in Internet-Projects, including keeping period and maximal number of private messages for Internet-Project Users, maximal number of sent messages for registered Users, symbol limit in messages, e.t.c User understands and agrees with the fact, that Company has a right to change rules without any notifications.

7. The ending of the Registartion

User understands and agrees with the fact, that Company has a right to disable his account in any Internet-Project and to delete any User messages. The reason of such actions can be breaking of the rules of the present UA, inactive account or any other reason. If the Users’ account is not used for more than 6 month, it can be deleted. User understands and agrees with the fact, that Company has a right to close any Internet-Project without notification. Also the "NIKITA.ONLINE Passport" is not responsible for closing the access to any Internet-Project.

8. The Ownership rights of Company

User accepts and agrees with the fact that the "NIKITA.ONLINE Passport" and other necessary programs are protected by the rule of copyright law, trademarks, patents, intellectual property law and other Russian and international laws. Some Internet-Projects give a right for User to use software, which is connected to Internet-Projects and "NIKITA.ONLINE Passport". The software is provided on the terms, which not allow modifying it by User or third persons; creating programs, based on Internet-Projects software; entering the software for getting program codes; selling, exchanging, renting, handing over the rights for Company software, which the User gets with the present UA and also modifying any of Internet-Projects for getting an unapproved access.

9. Guarantee release

User accepts and agrees with the facts, :

a) that User uses the Internet-Project on his own risk. Company is not responsible for any cases, including inconsistency between Users' aims and Internet-Projects.
b) that Company can not guarantee inconsistency between Users’ demands and Internet-Projects; that the connection will be fast, permanent, without mistakes; that the quality of purchases, services or information will be answering User’s demands; that all errors in Internet-Projects will be corrected.
c) that Company is not responsible for direct and indirect damages because of: using or not using Internet-Project; unapproved access to Users’ connections; behavior or expressions of any third person in Internet-Projects.

10. General Information

All requests, questions, complaints and other correspondence must be sent for "NIKITA.ONLINE Passport" on the e-mail address passporthelp@nikitaonline.ru. The present UA is legal contract between Company and User that regulate the usage of Internet-Projects by the User. User and Company agree that all questions and complaints about the UA will be solved by laws of the RF. Nothing in this UA can be understood as establishing agent, association, together, collaboration any other relations, which are not mentioned in the present UA, between Company and User. If some terms of the present UA are considered to be unnecessary or illegal by the judgment, the other terms are considered to be legal according to the present UA. Inactivity of the Company in the cases violation of the conditions the present UA by the User or any other users is not a reason for negligence in other cases of protecting Companys’ interests.

11. Informational security

User is obliged to save as a secret his password to his account. All User`s password are kept on in coded form, so that "NIKITA.ONLINE Passport" has no chance to read them and so, to give to the third persons. User is responsible for changing his password in time. If the password is lost, the User has a right to change his password if he will answer Control questions correctly or if he will make a request on the e-mail passporthelp@nikitaonline.ru.
